By accessing our website or using our services, you accept these terms. If you do not agree, you must not use the services. Customers should review and accept the applicable service terms before signing up for hosting, software or other services.
General Rules of Conduct
You agree to use our website and services in accordance with this agreement, applicable service policies and all local, national and international laws. You must not:
- Use the services for illegal activity, fraud, harassment, violence, terrorism or exploitation.
- Send spam, unsolicited bulk email or harmful messages, or attempt hacking, password cracking or network breaching.
- Upload viruses, worms, malware, phishing material or any code intended to damage systems.
- Infringe intellectual property, privacy, publicity or confidentiality rights.
- Host pirated software, illegal downloads, warez, gambling, Ponzi or pyramid schemes, or other prohibited material.
- Disrupt our infrastructure, bypass security controls, copy our content or resell services without written permission.
Probuz Technologies Pvt. Ltd. may classify other content as prohibited when it is indecent, hateful, misleading, harmful or generally unacceptable.
Resource Usage and Abuse
You must use hosting, bandwidth, storage, email and computing resources fairly and only for the intended service. We may investigate excessive usage, abuse, security risks or activity that affects other customers and may limit, suspend or terminate the affected service.
Email, Spam and Communication
Unsolicited commercial email, bulk email, mail bombing, address harvesting and similar activity are prohibited. You are responsible for obtaining consent from recipients and for complying with applicable communication and data-protection laws.
Transfers, Migrations and Backups
Transfers and migrations depend on technical compatibility and the information supplied by the customer. Customers are responsible for maintaining independent backups of their website, data, email and applications. We may provide backup features where stated in the selected service, but no backup service should be treated as the only copy of your data.
Domains and Account Details
You are responsible for providing accurate account, billing and contact details and for keeping login credentials secure. Domain registration, renewal, transfer and infringement matters are subject to the applicable registrar rules. You are responsible for renewing domains on time and for ensuring that your chosen domain does not violate another party's rights.
Service Uptime and Suspension
We aim to provide reliable services, but maintenance, upgrades, security events, network issues, third-party failures and events outside our control may affect availability. We may suspend or disable a service for non-payment, excessive resource use, security risk, suspected fraud, legal requirements or violation of these terms.
Billing, Payments and Taxes
Services are billed according to the selected plan, order, invoice or renewal period. You are responsible for timely payment of fees and applicable taxes. Prices and promotions may change for future orders. If you believe an invoice is incorrect, contact our billing team at finance@probuztech.com promptly.
Cancellation and Termination
You may request cancellation according to the process and notice period applicable to your service. Probuz Technologies Pvt. Ltd. may terminate or suspend an account when you discontinue the service, fail to pay, do not renew on time, violate these terms, create a security or fraud risk, or initiate an improper dispute or chargeback. Amounts already paid are refundable only where the applicable service terms or law provide for a refund.
Money-Back and Guarantee Terms
Any money-back offer or uptime guarantee applies only when expressly stated for the specific service and is subject to its exclusions, claim process and eligibility conditions. Maintenance, customer configuration, third-party outages and events beyond our control may be excluded.
Intellectual Property
Website design, text, software, trademarks, graphics and other Probuz content belong to Probuz Technologies Pvt. Ltd. or its licensors. You may use the services only as permitted by your agreement. You must not reproduce, modify, distribute, reverse engineer or create derivative works from our content or technology without written permission.
Indemnification
You agree to defend and indemnify Probuz Technologies Pvt. Ltd., its affiliates, employees and service providers against claims, losses, costs and expenses arising from your use of the services, your content, your breach of these terms or your violation of law or another person's rights.
Limitation of Liability
To the maximum extent permitted by law, Probuz Technologies Pvt. Ltd. is not liable for indirect, incidental, special, consequential or punitive loss, loss of profits, data, business or goodwill arising from use or inability to use the services. Our total liability will be limited to the fees paid for the affected service during the applicable period, subject to mandatory legal rights.
Dispute Resolution and Jurisdiction
Disputes should first be raised with Probuz Technologies Pvt. Ltd. so the parties can attempt to resolve them in good faith. Unless applicable law requires otherwise, disputes will be subject to the jurisdiction of the courts applicable to our registered office in India.
Changes to These Terms
We may update these Terms of Service when our services, policies or legal obligations change. The updated version will be posted on this website. Continued use of the services after an update means you accept the revised terms.
